What This Session Addresses

Why difficult conversations fail
before a word is spoken

Legal professionals conduct more high-stakes conversations than almost any other profession. Negotiations, difficult instructions, cross-examination, delivering adverse outcomes, challenging a client’s position, managing conflict within a team or chambers. The technical skill for each of these is assumed. What is rarely addressed is what happens neurologically in the moments leading up to them and during them.

Under conditions of perceived threat or high social stakes, the brain’s threat-detection systems activate before rational processing has fully engaged. This produces predictable patterns: over-preparation that locks the practitioner into a single approach, reactivity that breaks rapport at the critical moment, or over-control that reads as evasive or unconvincing. This session addresses the neuroscience behind those patterns and how to interrupt them deliberately.

After This Session You Will
Understand the neurological sequence that drives reactive conduct in high-stakes conversations and how to interrupt it before it compromises the interaction
Regulate your own cognitive and emotional state during difficult interactions without suppressing the information your instincts are providing
Conduct high-stakes conversations with the presence and precision that legal outcomes require, including when the other party is hostile, irrational, or deliberately destabilising

Who This Is For

Every legal professional conducts
high-stakes conversations.

Litigators and advocates

Practitioners who cross-examine, negotiate settlements, manage hostile parties, and deliver outcomes under judicial or client scrutiny, where the quality of the interaction is as consequential as the quality of the argument.

Attorneys in commercial practice

Legal professionals managing complex negotiations, difficult client relationships, and instructions that carry significant financial or reputational risk on both sides.

In-house counsel and GCs

Legal leaders who must challenge business decisions, manage internal conflict, and deliver difficult legal assessments to executives who may not want to hear them.

Compliance and risk professionals

Practitioners whose role requires difficult conversations with senior stakeholders in environments where the conversation itself carries professional and regulatory consequences.
